Terms of Service

1. Acceptance of Terms

By accessing or using ContentFlash AI, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you are using ContentFlash AI on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

2. Eligibility

• You must be at least 18 years old to create an account.
• You must provide accurate and complete information when registering.
• Accounts may not be shared. Each login credential belongs to one individual user.
• We reserve the right to refuse service to anyone for any reason at our discretion.

3. Your Account

You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account. Notify us immediately at support@contentflashai.com if you suspect unauthorized access.

4. User Content & Data Ownership

• You own your data. All forms you build, form responses you collect, and any content you create through ContentFlash AI remain your property. We do not claim any ownership rights over your content.
• License to operate the service: By using ContentFlash AI, you grant us a limited, non-exclusive license to process and store your content solely as necessary to provide the service to you.
• Export anytime: You may export your form data and responses at any time in CSV or JSON format. We will never lock you out of your own data.
• Deletion: When you delete forms, responses, or your account, we delete your content from active systems within 30 days, subject to legal retention requirements.

5. Prohibited Uses

You may not use ContentFlash AI to:

• Send spam, unsolicited bulk messages, or deceptive communications
• Collect personally identifiable information (PII) without proper consent or in violation of applicable privacy law (including GDPR, CCPA, and India's DPDP Act)
• Create forms designed to phish, defraud, impersonate, or deceive respondents
• Publish, distribute, or collect illegal content including content that violates intellectual property rights or promotes violence
• Use the platform to build services that compete directly with ContentFlash AI without our written consent
• Attempt to reverse-engineer, scrape, or circumvent any security or access controls
• Interfere with or disrupt the integrity or performance of the service

We reserve the right to suspend or terminate accounts that violate these prohibitions without notice.

6. Billing & Payments

• SaaS subscriptions are billed monthly or annually via Razorpay. Payment is due at the start of each billing cycle. All prices are in USD unless otherwise specified.
• AppSumo Lifetime Deal (LTD) purchases are processed by AppSumo and are one-time payments. LTD limits are set at the tier purchased and do not auto-upgrade.
• We reserve the right to change pricing at any time. Existing subscribers will receive at least 30 days' notice of price changes before they take effect.
• Failure to pay may result in service suspension until payment is made current.

7. Refund Policy

• AppSumo Lifetime Deal: Subject to AppSumo's standard 60-day money-back guarantee. Refunds for LTD purchases are processed by AppSumo directly through their refund process — not by ContentFlash AI.
• Direct SaaS subscriptions: We offer a 30-day refund window for new subscribers who are not satisfied with the service. Contact support@contentflashai.com within 30 days of your first payment. No refunds are issued after 30 days or for partial billing periods.
• Accounts terminated for violation of these Terms are not eligible for refunds.

8. Service Availability

• We strive for high availability but do not guarantee uninterrupted service. Planned maintenance and unexpected downtime may occur.
• No SLA on Free plan. Free-tier users are not entitled to any uptime guarantee or priority support.
• Paid subscribers receive best-effort uptime. We do not currently offer a formal SLA with credits or penalties.
• We reserve the right to modify, suspend, or discontinue any feature or the service as a whole with reasonable notice.

9. Intellectual Property

The ContentFlash AI platform, including its design, software, and brand, is owned by us and protected by applicable intellectual property law. You may not reproduce, distribute, or create derivative works from our platform without written consent. ContentFlash AI-generated form structures belong to you once generated.

10. Limitation of Liability

To the fullest extent permitted by law, ContentFlash AI shall not be liable for any indirect, incidental, special, consequential, or exemplary damages arising from your use of the service, including loss of data, revenue, or goodwill. Our total liability to you for any claim arising out of these Terms shall not exceed the amount you paid to us in the 6 months immediately preceding the claim.

11. Termination

• By you: You may cancel your account at any time from account settings or by emailing support. Cancellation takes effect at the end of the current billing period for paid plans.
• By us: We may suspend or terminate your account immediately if you violate these Terms, engage in fraudulent activity, or if required by law. We will provide reasonable notice where possible.
• Upon termination, your right to use the service ends. We will make your data available for export for 30 days following termination, after which it will be deleted.

12. Governing Law

These Terms are governed by and construed in accordance with the laws of India. Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts located in Bangalore, Karnataka, India.

13. Changes to These Terms

We may update these Terms from time to time. We will post the updated Terms on this page with a new effective date. For material changes, we will notify you by email. Your continued use of ContentFlash AI after changes take effect constitutes acceptance of the updated Terms.
